Poland's 2026 planning reform: what the plan ogólny means before you buy a plot

Polish municipalities have until 31 August 2026 to adopt a plan ogólny. Planning decisions (warunki zabudowy) that became final from 1 January 2026 now expire after 5 years, and once a plan ogólny takes effect in a given municipality those decisions are only available for plots inside a designated infill area.

If you are buying land near Gdańsk without a local zoning plan, this is the single most important thing to check before you sign. Here is what changed, in plain terms.

What is the plan ogólny?

The plan ogólny is a general municipal plan that sets the spatial development framework for an entire gmina and replaces the former study of conditions and directions (studium).

The critical difference: the plan ogólny is binding law. The old study was a policy document — it signalled intent but was not a basis for decisions. The plan ogólny is local law, binding on the municipality and on you. It divides the gmina into planning zones, and it decides where planning decisions can still be issued at all.

What changed for planning decisions

BeforeAfter
Validity of a planning decisionindefinite5 years from becoming final (for decisions final from 1 Jan 2026)
Where one can be obtainedanywhere the “good neighbour” rule was satisfiedonly inside an infill area (obszar uzupełnienia zabudowy) set in the plan ogólny
Governing documentstudy (non-binding)plan ogólny (local law)
If the municipality has nonedecisions issued as normalno plan ogólny → new decisions blocked

The “good neighbour” principle — pointing at the developed plot next door as justification — stops being a basis on its own. What counts is whether your plot sits inside an infill area. And designating those areas is optional for the municipality, so a plot that qualifies today may not qualify later.

Will an existing planning decision expire?

Not if it is old enough. The transitional rules:

  • Final before 1 January 2026 — remains valid indefinitely.
  • Application filed before 16 October 2025 — keeps indefinite validity even if the decision came later.
  • Final from 1 January 2026 — expires 5 years after becoming final.

If you hold an older decision and have been putting the build off, that is good news. If you are only now applying, the five-year clock is a real constraint: the building permit has to land inside that window.

Does Gdańsk have a plan ogólny?

No — as of July 2026 the Gdańsk plan ogólny is still a draft. Public consultation closed on 31 March 2026, the submissions were reviewed, and the draft went back out for further review and opinions. The work is run by Biuro Rozwoju Gdańska.

By contrast, Gdynia has already adopted its plan ogólny. Nationally, the large majority of municipalities still have not, with the deadline at the end of August.

For Gdańsk the consequence is simple: if the plan ogólny is not in force by 31 August 2026, from 1 September no new local zoning plans can be adopted until it is.

What to do before you buy

  1. Check whether the plot is covered by a local zoning plan (MPZP). If it is, this reform affects you far less — the zoning plan governs and is a direct basis for a building permit. You just need an extract.
  2. If there is no zoning plan, check the plan ogólny status in that municipality. It decides whether your plot sits anywhere a planning decision can still be issued.
  3. Read the draft plan ogólny if it is on public display. It shows where the municipality intends to designate infill areas — the best signal available before it becomes law.
  4. Do not buy a plot “for a house” without checking both. An attractive plot with no zoning plan and outside an infill area is a plot you may not be able to build on.
  5. Holding a valid decision? Count your five years and plan the design so the permit fits inside them.

A feasibility check on the plot and its planning status is the first thing we do on any project — see what our service covers. If you are choosing between plots, do it before the purchase.

Where these dates come from

The changes follow the spatial planning reform introduced by an amendment to the Act on Spatial Planning and Development. The deadline has already moved twice — the plan ogólny was originally due to apply from the start of 2026, then 30 April 2026, and now 31 August 2026.

FAQ

Frequently asked questions

What is the plan ogólny in Poland?

The plan ogólny is a general municipal plan that sets the spatial development framework for an entire gmina (municipality) and replaces the former study of conditions and directions. Unlike the study, it is local law and binds both the municipality and investors. It determines where a planning decision can still be issued at all.

When must Polish municipalities adopt a plan ogólny?

The deadline is 31 August 2026. It has already been moved twice — originally the end of 2025, then 30 April 2026. If a municipality misses it, from 1 September 2026 no new local zoning plans can be adopted there until the plan ogólny is in force.

How long is a Polish planning decision (warunki zabudowy) valid?

Planning decisions that became final from 1 January 2026 expire 5 years after they become final. Decisions that became final before 1 January 2026 remain valid indefinitely, as do decisions from applications filed before 16 October 2025 even if they were issued later.

Does Gdańsk have a plan ogólny yet?

No. As of July 2026 the Gdańsk plan ogólny is still a draft — public consultation closed on 31 March 2026 and the draft went back for further review. Neighbouring Gdynia has already adopted its plan. Check the current status with Biuro Rozwoju Gdańska before making any investment decision.

Can I still build on a plot with no local zoning plan?

Only if the plot falls inside an obszar uzupełnienia zabudowy (infill area) designated in the municipality's plan ogólny. Designating those areas is optional for the municipality, so some plots that qualify today under the old good-neighbour rule may not qualify afterwards. Verify this before you buy, not after.
